Changes to Request for Hearing and
Response to Issues Forms
WCB has made
some modifications to its Request for
Hearing and Response to Issues
forms. Most are format changes. We also have added a line on the forms
for the party/representative to advise if an interpreter will be needed
and for which language, as well as a box pertaining
to Own Motion denials.
Please destroy
the old versions of the Request for Hearing and Response to Issues forms.
You can access the new forms on WCB's website at www.wcb.oregon.gov/pdf_file/eform.htm.
It is available in both PDF and WORD formats. If you choose to create
your own forms, please make sure they include all the information on the
above-referenced revised forms. Regarding the last two bullet items ("bifurcation"
and "consolidation") on the Request for Hearing form:
- If you want the Request for Hearing that is being filed to have
a different WCB case number and hearing date from a pending
case involving the same claim or claimant, you should check the "yes"
box following the bifurcation bullet item on the form, and
check the "no" box following the consolidation bullet item.
- If you want the Request for Hearing that is being filed to be consolidated
with a pending case (i.e., not scheduled for a different hearing
date), you should check the "no" box following the bifurcation
bullet item, and check the "yes" box following the
consolidation bullet item.
WCB's administrative
staff receives many Requests for Hearing that have both "yes"
boxes or both "no" boxes marked. Such conflicting requests
cannot be accommodated; when this happens WCB's staff will consolidate the
new Request for Hearing with the pending case. |
